Cancellation & Refund Policy

  • Noshtok ("We," "Us," "Our," or "Company") operates a cloud-based point-of-sale software application under the brand name "Noshtok" for restaurants and food service businesses. Our platform integrates mobile and card payments, inventory management, deals and promotions, ordering and delivery integrations, table booking, analytics, and related services. The Noshtok Platforms and Noshtok Subscription are collectively referred to as our services.
  • The Noshtok Platform and Noshtok Subscription services are subject to our Terms of Service. "You," "Your," or "User" means any person who accesses or uses our platforms. You may select a subscription plan and make payments through the available payment methods on our platform.

Fees

  • A subscription fee ("Subscription Fee") is required to access the Noshtok Subscription. The Subscription Fee for Noshtok Subscription as stated in various subscription plans is non-refundable, and no refunds are eligible for services from our platform except as expressly set forth in these cancellation and refund terms. Taxes may apply as per applicable law. Your paid Noshtok Subscription is activated upon successful payment.

Subscription Cancellation & Refund

  • You may cancel your paid Noshtok Subscription at any time by visiting your account settings. If you cancel within 15 business days of signing up, a full refund (credit note) will be issued; however, the value of Noshtok benefits used during this period may be charged or withheld. For annual Noshtok Subscription cancellations at any other time, a prorated refund (credit note) will be issued based on the extent of usage.
  • For cancellation of monthly Noshtok Subscription, a refund will only be issued if no usage or benefits have been taken since payment of the subscription fee. It will take up to 30 days to process the refund to your bank account.

Revisions

  • We may change the Terms of Service and this Cancellation & Refund Policy without prior notice. If any change is found invalid or unenforceable, it is severable and does not affect the validity of other terms. YOUR CONTINUED SUBSCRIPTION AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR SUBSCRIPTION.

Termination by Us

  • We may terminate your Noshtok Subscription at our discretion without notice. In such cases, a credit note and a prorated refund based on the remaining term (annual or monthly) will be given. However, no refund will be given for terminations related to conduct that violates the Terms of Service, applicable law, involves fraud or misuse of the Noshtok Subscription, or is harmful to our interests or other users. Our failure to insist upon or enforce strict compliance with the Terms of Service or this Cancellation & Refund Policy does not constitute a waiver of our rights.

Limitation of Liability

  • To the fullest extent permitted by law, we, our directors, officers, employees, agents, or other representatives will not be liable for any direct, indirect, special, incidental, consequential, or punitive damages, or any other damages whatsoever arising out of or related to the Noshtok Platforms. Our total liability will not exceed the last Subscription Fee you paid. These exclusions and limitations apply to the fullest extent permitted by law and will survive cancellation or termination of your Noshtok Subscription.
